Sumario:This paper concerns about the effects of the criminal review in Jury Court decisions. More specifically, is analyzed whether, in a successful criminal review, the Judge should only submit the defendant to a new trial or should absolve him immediately. The central idea is to contribute to the debate and to indicate an appropriate solution in national procedural system. To do so, in a first place, is analyzed the premises that involve the criminal review, then, the principle of the sovereignty of the verdicts, and, finally, is examined the compatibility between rescission effect and procedure system. It´s applied the hypothetical-deductive method, using doctrine, legislation and jurisprudence. Finally, it was concluded that the Judge should only submit the defendant to a new trial, aiming, this way, a cohesive criminal legal system.
