Sumario:Shared Custody emerged in the Brazilian legal scene connected to the commitment to family links after marital separation. Thus, this article aimed to analyze the supremacy of mothers in relation to child custody in the post-divorce context. To this end, semi-structured interviews were conducted with judges and prosecutors. The data was analyzed using thematic content analysis. As a result, it is mentioned that there is still a traditional perspective, in which mothers exercise centrality, countering the current demands for sharing care, highlighting the need to expand the applicability of shared custody to enable joint and active responsibility.
