Sumario:Today's society perceives conflict as a negative phenomenon. In this context, conflict mediation was established in the Civil Procedure Code with the aim of re-establishing dialogue and, across the board, providing consensus. The article 334, §8 of the CPC is analyzed, whether it is positive in bringing a monetary penalty, in cases of unjustified absence in a mediation hearing, or whether it impedes the functioning of the institute by interfering with the autonomy of the will. The constitutionalized civil process and the consensual method in Brazilian civil procedural legislation were examined, and their influence on access to justice. Bibliographical research was used, of a qualitative nature, using the hypothetical deductive method, with an exploratory nature. It appears that the fine stipulated in the legal provision is beneficial for mediation, with no violation of the principle of autonomy of will. However, concrete circumstances must be considered in order to preserve the self-determination of subjects.
