| Resumo: | This search intends to analyze the problem of access to justice, understood not only as the mere possibility of obtaining judicial protection , but in a broader sense, understood as access to information, possibility of views exhibition and construction of law. The initial approach takes place with the presentation of controversial aspects of access to justice and quality of jurisdiction for, later and from the encounter with the discursive theory , find the link between the issues and benefits of their application. In this sense , using the hypothetical - deductive method, the research will use as a theoretical Germanphilosopher Jürgen Habermas, using his discursive theory of law and the state to rebuild an understanding of access to justice theme. |
