Sumario:Determining the law applicable to succession cases involving international or interregional elements requires a clear interpretation of Article 9.8 in fine of the Spanish Civil Code, particularly with respecto to the concerning the isuccession rights of the surviving spouse. The Supreme Court Judgment of 5 December 2024 —the third decision by the on this issue— establishes a definitive criterion: the law governing the matrimonial property regime should take precedence in determining the succession rights of the surviving spouse. This doctrine remains highly relevant for all succession proceedings not governed by the European Succession Regulation, thereby enhancing consistency and predictability in the resolution of future cases.
