| Sumario: | Determining the law applicable to succession cases involving international or interregional elements requires a clear interpretation of Article 9.8 in fine of the Spanish Civil Code, particularly with respecto to the concerning the isuccession rights of the surviving spouse. The Supreme Court Judgment of 5 December 2024 —the third decision by the on this issue— establishes a definitive criterion: the law governing the matrimonial property regime should take precedence in determining the succession rights of the surviving spouse.
