Descripción
Sumario:This article aims to analyze the guarantee of authenticity through Non-Fungible Tokens and the (in) validity for the protection of intellectual works, with a special focus on artistic works. The research was developed using the hypothetical-deductive method, based on the bibliographic review, and is justified due to the growing number of communities of artists who adhere to the exhibition and sale of their creations in digital galleries and transact on a Blockchain. At first, the protection of intellectual property was studied, highlighting international conventions on the subject, as well as the provisions of Brazilian legislation; and, secondly, the concept of digital arts was studied, in order to assess, subsequently, the (in) validity of the registration of works through NFT’s. As the result of this research, we concluded that NFT could present a solution to assure both authorship and authenticity of productions in cyberspace, although still remains doubts about the security that this technology could effectively attest.
